{"id":39,"date":"2015-02-07T11:33:58","date_gmt":"2015-02-07T10:33:58","guid":{"rendered":"http:\/\/hervelin.com\/blog\/?p=39"},"modified":"2015-02-07T11:35:10","modified_gmt":"2015-02-07T10:35:10","slug":"spam-sms-la-reglementation-francaise","status":"publish","type":"post","link":"https:\/\/hervelin.com\/blog\/archives\/39","title":{"rendered":"SPAM SMS &#8230; la r\u00e8glementation Fran\u00e7aise."},"content":{"rendered":"<p><a title=\"CNIL: prospection commercial sms mms\" href=\"http:\/\/www.cnil.fr\/les-themes\/conso-pub-spam\/fiche-pratique\/article\/la-prospection-commerciale-par-sms-mms\/\" target=\"_blank\">Source: http:\/\/www.cnil.fr\/les-themes\/conso-pub-spam\/fiche-pratique\/article\/la-prospection-commerciale-par-sms-mms\/<\/a><\/p>\n<div class=\"col-right\">\n<div class=\"htmlarea\">\n<h2>La prospection commerciale par SMS-MMS<\/h2>\n<div class=\"bloc_gris \">\n<div class=\"bloc_desc\">\n<p class=\"chapeau\">Le principe : pas de SMS publicitaire sans accord pr\u00e9alable du destinataire<\/p>\n<\/div>\n<div class=\"breaker\"><\/div>\n<\/div>\n<div class=\"tt_news-content\">\n<h3 class=\"avec_fond\">LA PROSPECTION PAR MESSAGE SMS et MMS<\/h3>\n<h4><strong>Le principe : pas de message commercial sans accord pr\u00e9alable du destinataire <\/strong><\/h4>\n<p class=\"bodytext\">La publicit\u00e9 par SMS \/ MMS est possible \u00e0 condition que les personnes aient explicitement donn\u00e9 leur accord pour \u00eatre d\u00e9march\u00e9es, au moment de la collecte de leur num\u00e9ro de t\u00e9l\u00e9phone portable.<\/p>\n<h4>Deux exceptions \u00e0 ce principe :<\/h4>\n<ul>\n<li><strong>si la personne prospect\u00e9e est d\u00e9j\u00e0 cliente de l&#8217;entreprise et si la prospection concerne des produits ou services analogues \u00e0 ceux d\u00e9j\u00e0 fournis par l\u2019entreprise. <\/strong><\/li>\n<li><strong>si la prospection n&#8217;est pas de nature commerciale (caritative par exemple)<\/strong><\/li>\n<\/ul>\n<p class=\"bodytext\">Dans ces deux cas, <strong>la personne doit,<\/strong> <strong>au moment de la collecte<\/strong> de son num\u00e9ro de t\u00e9l\u00e9phone,<\/p>\n<ul>\n<li><strong>\u00eatre inform\u00e9e <\/strong>que son num\u00e9ro de t\u00e9l\u00e9phone portable sera utilis\u00e9 \u00e0 des fins de prospection,<\/li>\n<\/ul>\n<ul>\n<li><strong>\u00eatre en mesure de s\u2019opposer <\/strong>\u00e0 cette utilisation de mani\u00e8re simple et gratuite.<\/li>\n<\/ul>\n<h4><strong>Chaque message doit obligatoirement<\/strong> :<\/h4>\n<ul>\n<li><strong>pr\u00e9ciser l&#8217;identit\u00e9 de l&#8217;annonceur<\/strong>,<\/li>\n<li>proposer <strong>un moyen simple\u00a0de s&#8217;opposer<\/strong> \u00e0 la r\u00e9ception de nouvelles sollicitations (par exemple, un n\u00b0 de t\u00e9l\u00e9phone non surtax\u00e9 o\u00f9\u00a0il est possible de se d\u00e9sinscrire \u00e0 la fin du message).<\/li>\n<\/ul>\n<p class=\"bodytext\">La CNIL recommande que le consentement pr\u00e9alable ou le droit d&#8217;opposition soit recueilli par le biais d\u2019une case \u00e0 cocher.
